Acceptance of Terms

By accessing or using First Gen Finance, operated by Atlas Peak Media, LLC ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

First Gen Finance is a financial literacy platform that provides educational content, interactive flashcards, and financial calculators. The Service is available on the web and as an iOS mobile application. The Service is designed for educational purposes only and does not constitute financial advice.

User Accounts

• You may create an account using email and password, Apple Sign-In, or Google Sign-In (coming soon). Certain features are also available in a guest or demo mode without an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating your account.
• You must be at least 13 years old to use the Service.
• You are responsible for all activity that occurs under your account.

Subscriptions and Billing

Subscription Tiers

The Service offers three subscription tiers:

• Foundations (Free): Basic access to educational content and tools at no charge.
• Building / Plus ($6.99/month or $59.99/year): Enhanced access to premium content, advanced tools, and additional features.
• Wealth / Pro ($14.99/month or $119.99/year): Full access to all content, tools, priority support, and exclusive features.

Billing and Auto-Renewal

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis.

Payment Processing

On the web, payments are processed through Stripe. On iOS, payments are processed through Apple In-App Purchase. We do not directly store your credit card information.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to your paid features until the end of your current billing period. No partial refunds will be issued for unused portions of a billing period.

Refunds

For web subscriptions processed through Stripe, refund requests are handled on a case-by-case basis. Please contact us at support@firstgenfinance.com. For iOS subscriptions purchased through the App Store, refunds are managed by Apple in accordance with their refund policies.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Copy, modify, or distribute content from the Service
• Use automated systems to access the Service
• Share your account credentials with third parties
• Circumvent or attempt to circumvent any subscription restrictions or access controls

Educational and Financial Disclaimer

Important: The content provided by First Gen Finance is for general educational and informational purposes only. It is not intended to be, and should not be construed as, financial, investment, legal, tax, or accounting advice.

• We do not provide personalized financial advice, investment recommendations, or portfolio management services.
• The calculators, tools, and simulations are for estimation and educational purposes only. They may not reflect your actual financial situation and should not be relied upon for making financial decisions.
• You should consult with qualified, licensed financial professionals before making any financial, investment, or tax decisions.
• We are not a registered investment advisor, broker-dealer, or financial planner. Nothing in the Service constitutes a solicitation, recommendation, or offer to buy or sell any securities or financial instruments.
• We are not responsible for any financial losses, damages, or consequences resulting from decisions you make based on our content.
• Past performance examples or hypothetical scenarios presented in the Service are not indicative of future results.

Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are the exclusive property of Atlas Peak Media, LLC and are protected by copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the fullest extent permitted by law, Atlas Peak Media, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. In no event shall our total liability to you for all claims arising from the Service exceed the amount you paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, for any reason, without notice. You may also delete your account at any time through your profile settings. Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Dispute Resolution and Arbitration

Binding Arbitration:Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the Commonwealth of Virginia, United States, unless you and we agree otherwise.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Atlas Peak Media, LLC.

Exceptions: Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Changes to Terms

We may modify these Terms of Service at any time. We will notify users of any material changes by posting the new terms on this page. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Virginia.
